On 2/11/13 the department of licenses and inspections issued a notice of refusal for application #428251.

Permit for the lot adjustment to create two (2) lots (parcel "a" and parcel "b") from one (1) existing lot (2216-2222 walnut st). Size and location as shown on plans (no change to height or area of existing structures). Parcel "a" - for use as business and professional offices on the 1st floor and educational facility on the 2nd through 4th floors, as previously approved. Level i structural alterations (no change of occupancy) for repairs to concrete slab of first floor as per approved plans.

For use as prepared food shop, sit down restaurant and accessory residential space on the 1st floor and multi-family household living (one hundred and fourteen (114) dwellings) on the 2nd through 9th floors, as previously approved. See a p no 638181 for lot adjustment. Provisos per letter ccra dated 2 4 16: 1. All trash waste generated at the premises that are the subject of this application will be internally stored until such trash waste is removed by a reputable and licensed trash disposal company. Trash waste will not be present on the exterior of the premises at any time and no dumpsters will be used for the premises that are the subject of this special exception. 2. There will be no use of the property as an educational facility.

Exterior renovations to the first floor corner tenant including the installation of non-operable aluminum storefront system with glazing on the walnut street facade to match existing configuration. Bi-parting operable storefront systems with glazing on the south 23rd street facade. Finish to match existing. Remove infill at existing window opening along 23rd facade and provide new 6 over 1 double hung window to match rear double hung window. Remove existing sidewalk hatch to existing basement and enlarge sidewalk opening per plans approved by streets dept. To accommodate new ships ladder down to existing basement (not for egress). All work per historical commission approval, no fit-out, no c o associated with this permit.

Interior fit out of an existing floor vanilla box space in a multi story building to create a restaurant inclusive of interior partition walls floor finish ceiling tile and grid casework equipment and all related utility work as per plans. Separate permits required for m, e, p and fss.

For level ii alterations for a fit-out of new tenant in existing restaurant space; new fixtures, kitchen appliances (no changes to existing kitchen hood), alterations to partitions, ada upgrades to existing bathroom and counters as per plans. Separate permit required for all electrical, mechanical, plumbing, and or fire suppression work.
