Swr january 25, 2006 4:37:23 pm stuartr ; zoning was dis-approved as portion of deck encroaches within minimum required rear yard setback zoning dis-approval only applies to exterior work. In no way shall this zoning dis-approval delay any proposed interior work ; after waiting weeks for a revised site plan, and multiple phone conversations with applicant contact, i feel certain the after the fact deck constructed does not minimum rear yard setback. Planning staff will issue the property owner a notice of violation sometime the week of feb 20th 2006( due to the setback requirement) and require part of the deck structure to be removed.
